Value is the thing to establish first. SEBI’s simplified transmission route stops at ₹10 lakh per company for physical shares and ₹30 lakh for demat holdings. Cross those limits and the family needs a will, a legal heirship certificate or a succession certificate, so an accurate valuation decides the route.

West Bengal documentation

In West Bengal a legal heir certificate is applied for through the state e-District portal or at the office of the Sub-Divisional Officer or Block Development Officer. Families are generally asked first for a family tree or heirship list from the local body — the ward councillor in a municipal area, the Gram Panchayat Pradhan in a rural one — after which a revenue inspector verifies locally.

Often no such certificate is needed at all. SEBI’s simplified transmission route covers holdings up to ₹10 lakh per company in physical form and ₹30 lakh in demat, on a notarised indemnity bond and an affidavit-cum-NOC from the other legal heirs.

Is probate needed in West Bengal?

No. Section 213 of the Indian Succession Act was omitted with effect from 20 December 2025, and SEBI’s framework accepts a will with an indemnity bond for share transmission.

How long does a succession certificate take?

An uncontested petition often takes around six months and varies by court. It is worth confirming first whether your holdings actually need one.

Can the shares be divided between several heirs?

Yes. Families usually transmit to one or two heirs with NOCs from the rest, or divide the holding under a written family arrangement the registrar can follow. A demat account holds at most three names.
